Making the Call
A key difference between Bank of America and other lenders is that they don't require you to have a lot of information gathered before calling. Generally all you need is your loan number, the Bank of America Representative will be able to pullup your account information and go over it with you. They will ask you questions about your current financial situation so having the following items on hand may be helpful, but is not necessary:
- Recent pay stubs
- Any large recurring payments like college tuition or car payments
- Recent tax returns
Bank of America borrowers can call 1-888-293-0264 or the number listed on the most recent mortgage statement. Either way, they will be directected to the person or department that will be able to assist them.
Possible Options
Every situation is unique, and Bank of America representative will give borrowers the options that best suit their circumstances. Some of the options that Bank of America may present struggling homeowners include:
- Repayment Plans
A repayment plan brings the deliquent account current. The past due amount is paid over a period of time while the regular mortgage payments are made.
- Forebearance Plans
A forebearance plan would suspend the monthly payments for a short period of time. The specific terms of the plan would be determined by the borrower's circumstances.
- Refinancing
A new loan with different terms replaces the original loan. New terms may include a lower interest rate and a change in the length of the loan.
- Loan Modification
A home loan modification is still the original loan with some changes made to it. This is a good option for those who do not qualify for refinancing.
The sooner the borrower contacts Bank of America, the more options the representative will be able to offer and the more likely Bank of America will be able to help the borrower. While they would like to be able to help everyone, every case is unique and not all can troubled loans can be worked out. The only way to find out is to call.

I have been sending letters of hardship for over six months. Every time a different representitive calls, they know nothing about the account and situation.
We have been trying to get a modification, have been in this home for 15 years and no one from BAC has been helpful or polite. Every representative has given us a different story or time line. Now after six months they want another "letter of hardship".
Does this bank want us to lose the house or pay the loan??
I agree with fedup. I have been working with BAC since last year. We were approved for a mod loan, but it was only 50 dollars less than what our first payments were. I missed the third mod loan payment by 3 days and they canceled the mod loan. But stated that the mod loan was never "officaly" approved, I could apply for another mod loan. I have called on a weekly basis, and get a different person each time, stating something different. I have kept notes each time I called, down to date time and minute of what is said and recorded. I feel that this is going to continue and that I will fall deeply in debt to BAC and lose the home anyway. If they are wanting to work with homeowners, you would like to think that the system would be better used, since they are one of the "top dog's" of the mortgage companies. I can only hope and pray that this will all work out, but looking for another home to live in, just in case. very sad.
Don't even try to work with them, they'll get you in the end. Tried working with them, sent monthly payments that they requested to stay out of default. Then got told the note was written off. If you think they're bad wait till you talk to the hatchet men they sell your note to.
This is all so true. I have missed 2 monthly payments with BAC and call on a weekly basis for them to assist with a loan modification. Everytime I call I am transferred to a representative in India who sounds like they are reading from a script on a computer screen. Right now I am dealing with a company that deals strictly with home modifications to intercede for me, because I don't think I can do it on my own. BAC really needs a better system to help its customers. I have concluded that they are either overwhelmed with home modifications or they want to frustrate the "weak" and just push them into foreclosure.
I also agree with all the frustrated commentators before me. BAC is very difficult to work with and you get a different story from each dept./person you are transferred to until they get you off the phone. It is a bunch of baloney when they say to "call before you are in trouble" because they wouldn't do anything then either. Their website makes it look like they actually care to help. That is not the case at all!! Have been calling and sending correspondence to them for months and have gotten no where. We would gladly keep paying the mortgage if it was something affordable, but since a layoff has hit our house, that is not possible under our current terms...TOTALLY FRUSTRATED!!!!!!!!!!
I am 4 months behind in a home I am no longer living in. I was renting & cannot even do that now. I am trying to file for a deed in lieu of foreclosure & pay what my arrears are now wit my income tax. I don't want to just walk away, I don't want to file bankruptcy & I don't want a foreclosure. It is absolutely, utterly immpossible to reach a person with BAC that can help you. Today I again called the number specified, waited on hold for 12 minutes, spoke with a human, after spewing my story he needed to connect me with someone else. Listened to some horrible music for 10 minutes (I was determined to speak with someone) there was a click, then a dialtone. Called the number againwaited on hold for another 10 min., same music, same recording then click & "If you want to make a call blah blah blah-- recording. Still determined redialed, hung on for a endless minutes then click "we are unable to blah blah--" I have been doing this off & on for several months & am convinced they do not want to bother with any of their customers & have the attitude of let the chips fall where they may, they'll deal with us in the order presented, whether it be 5-10-15 years when they will file their lawsuits against all their customers they are ignoring now.
I have had all the above experiences. I have even tried to reach them by email but they guard that secret link!!! I wanr a Deed- lieu now, Bank of America. I am out of work on disability. MY salary cut in half. Applying for SSD. My need step is to walk away in a panic!!!!!
I am also experiencing the same prolems. My husband has been laid off for 6 months. I have tried to stay in close contact with BAC; letting them know I have every intention of getting my mortgage caught up. (I'm 3 mths behind) I've made partial payments every month; the I find out last week I was in pre-foreclosure. I received a letter yesterday starting I was in foreclosure. I don't know what to do or how to stop this. I can't believe we are about to lose a home that we've had for 5 years; over 3 payments!
I have been working with BOA since 10/2008, originally countrywide, and have had nothing but the run around and bold face lies.
Keep copious notes, take names, dates, times. They told me to do a short sale and when I had a buyer, they refused to respond to the offer. When I say refused, they did not return calls for months on end to even see if they would except the contract. I lost two buyers because of this unprofessionalism.

I am going through the same thing, is this being done in order for them to acquire our property? We have lived in our home for 12 years then a car accident and later a broken hip caused huge medical bills and we got behind. I am crying for help and they don't care.
I also have been going through the same after just 6 months late on my mortage they are selling my house on the courthouse steps tomorrow. I have called every day you get a call center with 1000 employees whom cant do anything. BOA says I do not qualify for any modifications. My husband was layed off last year. Is currently working at a job paying less than half. Whom is BOA working with anyone???
I have wrote every congressman and even Obama himself to get no answer from anyone.
i have been thru the same bs with bank of america i have lived in my home for 15 years was hit by a drunk driver who had no insurance i am now permanatly disabled can no longer work then when only thought things were bad wife left only owed 15,000 on my place got behind on payments and have jumped through a hundred hoops for boa never can talk to the same person twice no one knows what is going on or even seems to care when i can actualy talk to a real person im tranferrd till i get a dial tone and this is usualy after at least a hour of being on hold and shuffled around in forclosure now and owe 25000 after they added their lawyer fees and misc charges and once again waiting to get more paper work from them which im sure will be lost or misrepresented by them or just have them send it to me on the day that it has to be back to them then listen to some one tell me that i screwd it all up by not getting it to them in time if i havent been evicted i will soon owe them twice what i did when my problems started
BoA is a joke. We bought a home that had extensive water damage that the sellers covered up. After buying and living in the home a month, the whole house flooded. We contacted them immediately.. they dont even have proof of the loan at all! we even got an inspection, but wouldnt you know it, that company is no longer in business. after telling bank of america the situation, they sent out an appraiser and inspector who told them our house was unliveable and these were pre existing problems.. bank of america did not tell us this and we continued paying them for a year, without them allowing us to see the inspectors papers, even without any notice of them actually having the loan.. boa refuses our lawyers letters and will not speak to us. they cannot legally foreclose on us and we have been dealing with them since 2007. we cant buy another house because of this, even though they knew the home was damaged.
Bank of America should change their name to Bank Of India. Evry time you call the call center is in India! They dont raise an American Flag at any Bank. However, they were first in line for the taxpayer bailout plan. Now were are those funds for the distressed homeowner. They should just go out of business!!!! Thieves!!! Problem is that they are in bed with the Dems!
I agree! My husband and I has been getting a lot of bs from Bank of America.. every time we call representative gives us different answer.. We got a denial letter stating that we dont qualify for HAMP and that we have 14 days to call them to hold the foreclosure on our property and help us with other foreclosure alternatives.. we called right away after we read the letter.. A representative said we could try and re-apply for HAMP and that they'll mail us a packet to reapply for hamp... said it takes about 5-10days to get the packet.. said it should hold the foreclosure while our application is in process for review. That gave us so much hope thinking we still have a chance to keep our home.. 10 days later no packet came.. I waited a couple of days thinking it was just delayed.. when it didn't I called them again they said that I have to contact HOPE because they are not the ones who actually sent out the packet.. that they just order it on the computer and that HOPE is suppose to mail it to us.. it was Saturday.. HOPE was close.. called HOPE early in the morning the next business day which is Monday.. NO ANSWER.. called BOA.. turns out the first HOPE number they gave me was wrong and gave me another HOPE to call.. when I did finally get in contact with HOPE the hope representative said they didn't get any order and HOpe put me on hold n called the BOA department that gave me their number.. the new BOA representative then talk to me to see if I could still re-apply finally they told me that we cant and that we already exhaust all our options and the only thing we could do is either a short sale or died in lieu.. we pick the short sale.. we got transferred to the boa short sale department told us we need to get our property listed.. thats the same day we got a letter of foreclosure and auction date!! called boa again ask them what happen to the hold on the foreclosure since I called right away after I got the letter of denial to try and work with them.. they transferred me to a BOA counselor instead.. the counselor now said that we need to get an offer before the auction date or the foreclosure power of sales continues (which is on June 7).. there's no way we'll get an offer before the auction date.. there's soo many properties in our area that is still on the market.. we can't even do a deed in lieu now because again.. they said our property has to be on the market without an offer for 90 days.. Seems like they said what they had to say so that they can legally claim that they gave us that 14 days notice before we got the actual foreclosure letter. They gave us a runaround!! How do we fight this? Isn't what they did.. are still doing illegal? If they don't want to help us with the modification then all we want now is at least to get out of this mess with a chance for a better option in the future.. we just want to turn the key back now.. where can we find a savior??
I tried contacting them way back in October of 2009. I let them know this was going to happen because funds ran out. They didn't do a thing until I was 4 months overdue. Now it's in foreclosure.B of A need to pull their Heads out of their Ass.
Ive had the same problems as everyone else. Went through the modification process several times and at the end something messes it up and have to start over. Im so upside down now real estate agents wont even talk to me about a short sale because they say they know BOA will never accept any offer i could get in this market. And BOA wont work out a Deed in leau until its been on the market for 90 days.
Last April when everything was going south my husband's employer sold to a competitor and didn't receive a paycheck for a month. He lost his medical insurance also as the competitor considered all of the employees they retained as new hires. Medication was a priority over the mortgage so he could continue working. I contacted BoA immediately. Started the MHAP process. Called every week (like countless others) and was told my application was still being processed. I sent payments - not full payments but it was something - and found out all of my payments were in partial balance accounts and were not being applied to my loan. I had one BoA employee tell me to just stop sending payments because they wouldn't apply them to my loan - even if they were full payments, because my loan was in the modification process. I fought them on this until September 25th when I found out over the telephone my home had been set for sale on October 15th. I eventually got 8 letters from their attorney about the foreclosure. I called them and begged them for something in writing that had an amount to pay before a certain date to avoid foreclosure. They don't offer anything like that. I had the money to pay them in full and they refused it. I signed a lease that began on October 14th and was still loading stuff after midnight of the 15th when the county Sheriff came to verify I was moving. Then, in the middle of November - a FedEx package was left in the mailbox (a neighbor contacted me) and it was a payment plan. I called them and explained I had signed a lease and moved and had expected the home to be sold on October 15th. The person I spoke to said there was no record of foreclosure proceedings on my account. I just received a phone call from them today (7-1-10) and couldn't answer it. Sorry BoA - you lost me....9 months ago!!!!
I have read all the comments and relate to most. First of all it should be called Bank of India, cause that is who you talked to most. And they just read from a script, but that is a whole other story. My best advice is to send no more payments ever, and instist on the Deed in Lieu of foreclosure. Once you have told them this is what you will do they will take awhile but eventually do it, it is the chepest option for them as well. Get away from the mess!! If you want to keep the home then your in for a nightmare. BofA is giving cash incentives to do the Deed in lieu (3k-15k). Just my 2 cents. By the way BofA may be a pain in the a s s, but if you look at it from their standpoint they have a huge mess and are trying to get as much money out of these problems, it's just business decisions, do not think for a minute they care about you.
I feel for everyone on here. I try to get a fix loan with BOA as well. No one would help so I got invovled with the NACA fill out the form. BOA said they unable to do modifcation on the loan. So I got invloved with the NACA program they did fix the loan same day they send me a foreclosure. I did not understand that at all. On the same day they send me offer to the Naca website and foreclosure letter same day. This really mad me mad as hell now they want me to pay for something they they gave me a chance to answer. Call no one there is on the same dam page there. This is on the NACA website where Barney Frank ask question about why no one on e the same page. Please everyone got to the NACA website and listen and this program may be able to help everyone. It like they do not care. Why in the hell they gave people $4,000 for the car program. Why did money did not go to housing problem to help home owner. They putting these people in new cars then what if they do not make the payments then it be another bail out. Please veryone try the Naca Progran it help many people getting back to me the loan was fixed rate but only paying $100.00 less rate was a arm which was 3.75 now it to 3 percent fix but I thanks God for that. Please this process about kill me . I need help no one wanted to hwelp unless I miss payment. Please everyone I will pray for your all here. Everyone here need a blessing. Good luck to everyone. I have read all the postings. I fell behind in payments due to employment. Things are back on track and BOA will not accept my money. I have called 20 times in the past 2 weeks and they give me a different story everytime. The fees they are trying to charge are as much as the mortage payments are in the rear. They have been rude and very unprofesional with me. I am trying my best to not let the house go but i feel like they are giving me no choice.WHAT DO I DO ????????
I am so glad that I am not the only person in this mess that they call BOFA!! I have been working with them since Feb. of this year and my home was set to sell this coming Tuesday and I just found out yesterday that they did accept my request to postpone until I find out if I can get into the Making Homes Affordable program. I have started the bankruptcy process but if they won't help me or let me talk to someone that can I will have to just do it. After three months of only being able to send partial payments in they put me in foreclosure and when I tried to catch up the next month they sent my check back to me and now told me to just keep the money. I have had many sleepless nights and thoughts of suicide about this because I love my home and don't want to lose it. I keep praying to the good Lord for guidance and will continue to do so. I wish we could all band together and do something.
I was lied to by BAC and my identity sold. Lovely, I can now walk down the street singing my social security number and hand it out on business card. Thank you Bank of America. I was lied to about my modification process when I was only one payment behind and lied to every single month. None of my mortgage payments were applied to the loan jut sat in partial payment. So BAC you can have the house that is overpriced and now not worth even half of the mortgage note. Do not trust BAC they want you to be happily doing upkeep on the home until they can take away their fake modifications. They do want your home not now but for a later date.
I have called bac several times and get the same thing over and over again we can not help you unless your 90 days behind. Then they tell me the web site isn't for fha loans. Call back when you are 90 days behind. What am I suppost to do when my hudband is going to be off work for 6 months for surgery. So much for helping people they just want your house!
I guess we are fortunate. I don't know how, but our loan modification with BoA has gone very smoothly. I called them 3 months in advance, as soon as we knew we were divorcing and got word today that we were approved. I have a specific name and ext. for the underwriter writing our terms. I did not expect to find these horror stories on this board. I got on to talk about how great they have been. Oh my.....
I gave up and let BAC take my house into forclosure. BAC assigned the bid of my home to another bank and that bank bought my home for &100.00. I am waiting to see what BAC will do to me next.
We too were in the same place as all of you! Our house foreclosed at end of July.BoA pisses me off! They gave us a loan modification that was $100.00 more a month than our original loan, scared us into signing it, we got a middleman involved, cancelled the modification(3 wks after signing it), they would not work with us to do a new one, called every month, was told they were still trying and what happened?, they foreclosed anyway. Now, we can only rent, had to get rid of our beloved pets, uproot our kids, and now they have our house for sale as is.All we wanted was a lower interest rate like everybody else. The one BoA rep told me that even if they lowered the rate our payment would be the same. I am not stupid! They had us at a 6.5%, if you take the same amount and drop the interest, the payment goes down!We cannot help that my husband, a union carpenter got laid off! We called to work out something, just like they say to, but they didn't want to help!Oh, and Fannie Mae, they are the ones that said we already signed a modification and couldn't get a new one for 12 months!!!
All we wanted was a little help in a trying time! We don't live beyond our means or just buy everything! What really bugs me is right after they foreclosed, Fannie Mae asked the gov. for more bailout money! They wouldn't help us, but they want help themselves, how ignorant is that?! I will never patronize Bank of America or Fannie Mae and will bad mouth them til my grave !!!!!
Spoke to a BOA representative about making partial payments per month due to a potential divorce. The BOA rep stated that this was acceptable and that the payment I send would be held in a special account until enough funds were accured to make a full payment. We purchased the home 3 years ago and have had excellent service, including a refinance rate from a 7.0% to 5.4%. I appreciate all of your comments. Now I'm having second thoughts about trusting them in saying its ok to make partial payments.
We all seem to be having the same problems with this bank. I have NEVER dealt with such incompetency in my life!,Thank God they stopped all FC,BUT I still don't trust them. Does anyone know if there is a Class Action Suit coming up? we all need to protect each other from this kind of business Sher, we to ask if we could send partial, they said sure,well our home was to go up fro "auction" 10/14,but my request to postpone the sale because I was waiting to hear if we got "accepted" by their Mod. program,that was 10/4,they said I would have an answer in 72 hrs. I get no answer when i called back,then they announce they R stopping forclosures,THEN I get a fedexed letter saying I will hear from them in 30 days if we have been accepted or not,today we get a ck in the mail with no note as to why we got our payment back,hey i will pay my other bills with it.

IF ANYONE HAS HAD OR HAS A MORT. REPAYMENT PLAN WITH B.O.A. THAT WAS SET UP BY ATTY. DAVID STERN PLEASE TELL ME ABOUT YOUR EXPERIENCE. LAST NOVEMBER I ENTERED INTO ONE OF THESE PLANS(9 MONTH REPAY. FROM DEC. TO AUG. 2010. AT THAT POINT I WAS SUPPOSED TO BE CURRENT AND MY MORT. PAYMENT WAS TO GO BACK TO 949.00 UNLESS THERE WERE "ANY CHANGES IN MY INT. RATE, CHANGE IN ESCROW, OR LATE FEES". MY JULY STATEMENT SAID I HAD A 40.93 LATE CHARGE BUT OTHER THAN THAT THERE WERE NO OTHER CHANGES. SO I PAID 1498.00 FOR 9 MONTHS, WAS NEVER LATE, AND IN MID AUGUST(MY FINAL REPAY. MONTH) I RECIEVED A "NOTICE OF INTENT TO ACCELERATE" FORECLOSURE LETER SAYING 5680 WAS DUE BY SEPT 1 OR BOA WOULD PROCEED WITH THIS ACTION. ANYWAY, HERE IS THE KICKER. OVER THOSE 9 MONTHS I SPENT AT LEAST 60 HOURS ON THE PHONE WITH BOA AND THE STERN OFFICE AND TO THIS DAY BOA SAYS THEY HAVE NO DOCUMENTATION ABOUT THE REPAY, HAVE NEVER SPOKEN TO ANYONE AT THE STERN OFFICE(CONTRARY TO WHAT STERN SAYS), I HAVE ASKED BOTH TO CONTACT EACH OTHER(STERN SAYS THEY HAVE) AND TODAY I RECIEVED AN ORDER TO APPEAR AT COURT AGAINST BOA. THIS IS THE CRAZIEST THING I HAVE EVER GONE THROUGH. BOA MADE ME SPEAK WITH STERN AND ONLY STERN. I COMPLETE THIS REPAY, CALLING BOTH DOZENS OF TIMES(DOCUMENTING EACH CALL) DURING THE 9 MONTHS AND NOW THIS. OF THE 5680 3004 ARE LISTED AS "UNCOLLECTED COSTS" ALMOST 2953 ARE MONTHLY CHARGES, 81.86 LATE FEES, AND 430 IS LISTED AS A PARTIAL PAYMENT CREDIT? MARRIAGE FALLING APPART DUE TO FINANCIAL STRESS, CAN'T SLEEP OR EAT, DEEPLY DEPRESSED, AND AFTER YEARS OF SOBRIETY DRINKING AGAIN. I UNDERSTAND THAT I FELL BEHIND ON MY MORT., BUT I DID EVERYTHING THEY ASKED OF ME, I CALLED AND CALLED AND CALLED BOTH BOA AND STERN AND NOW THIS. THEY ARE WRONG AND I JUST PRAY THE JUDGE UNDRESTANDS.....WITH ALL THE INFO I HAVE THERE IS NO WAY HE CAN'T. IT MAKES ME WANT TO LAUGH BUT, I CAN'T STOP CRYING. WHAT DO I DO?

an email. BAC says they are about helping those facing
hardships --- well we known how that is going.
Send him an email --- explain your situation --- give your loan number / property address you should be contacted by someone from the Office of the President advising the next step.

payment is $400.00 less than my previous payment.

countrywide sold my loan in the middle of a modification then boa gave me the run around we even had people trying to buy our house and they kept refusing the offers needless to say they took my house and sold it at auction instead of letting us get out of the loan. i keep hearing there is help out there but i cannot get no one to help us. we bailed out boa i think they should bail me out. i am sick and tired of being used by the bank politics. no body helps the little mannnnnnnn. we have been working people all our lives for what. banks just want to keep us in debt. sick and tired
Thank you for whoever posted the email to Brian Moynihan. I used it after getting the run around by Bank of America since August 2010. Got a response back today by phone call from a head customer advocacy person from his office. Got a negotiator for my type of loan finally assigned after the last one declined the modification because my paper work got there 2 days later then their deadline that they didn't even tell me about. Gave me a direct callback to a head negotiator for my type of loan. I say try anything you have to and keep plugging away in getting someone to hear you. Its your house and you deserve to try and keep it.
BofA is a JOKE! They dont want to help you, all they want to do is take your money, fill you with false hope and then sell your house out from under you!
I've not missed a payment yet, I've paid extra towards principle each month for the last 6.5 years. April's payment does not exist. I was discharged through BK in January, I lost my business of 12 years and there is no work here... at least nothing that would cover my mortgage and basic living. I have 10k worth of repairs that need to be done before I can put up for sale, but I don't have the $ to do it and since the house here take over a year to sell, it wouldn't matter anyway. I've decided to just walk away. I was reading these posts to see how long it would take from my first missed payment until they change the locks. It sounds like if I pretend to 'want' to work it out and put up with their BS, I've got what? A few months? I should be able to get all the furniture out by then...
OMG! Now I'm worried, I had a temp hardship for about 6months, currently back on track with paying the full montly mortgage amount and extra payments to catch up. Im 5months behind and do not intend to fall any further. I have been intouch with BOA and durring that time of hardshi, I too did everything the bank wanted from me.
I see the same complaints, you never get the same person, the person who was assigned your case never calls because one rep "Stated they cannot make outgoing phone calls" When I did return a call, I find out the there are four reps with the same name...ughhhhh So I do feel for all of you.
My question I ask is, BOA is asking me for my income tax returns,paystubs and bank accounts. Again for like the third time. Is it safe to give them my copies of my entire income tax return.
I had a Chase Heloc loan that suffered during the time as well. I went to make a payment to it to bring the account current 1,500.00 only to find out it was charged off without a letter, phone call,e-mail via my chase account or even the mail. So I have this going on with Chase recovery and they are threatening to forclose on my BOA/Legal Actions. Keep in mind that I have offered to pay it back but chase recovery telling me pay this or face legal action.
My concern is to do the right thing here but I don't have all that money to give chase and to bring my BOA up to date. I want my home, have never even heard of a charge off because my wife and I have always paid our bills. Just had a temporary set back.
So does anyone have any recommedations for this new york guy?
So is it safe to say I will not lose my house to Chase even if I am making payments to BOA an getting caught up with my five passed payments.

I been having the same problems for over 1 year now. I had called early last year that I was about to go through a divorce and needed some assistance but was told because I was current they would not help me. I finally decided to miss payments once my divorce was filed and 3 days later I get a call and that now I had options. Well, I tried a short-sale only for the bank to over value my house and have potential buyers walk away. I tried a deed-in-lieu that took them about 2 months to contact me to start the process. Once the deed-in-lieu started, they said if approved, I was going to be asked to sign a promissory note, which makes no sense. Then they found a judgment on the house, which they did not provide any information about it. It took me two days to figure out what the hell they were talking about. It turn out it was for child support which is standard practice in California to put a judgment on a non-custodial parents home but no back payments were owed.
I finally called the bank back two days later and to find out they the file was closed. All they had to do was fax a letter of demand to release the judgment (or something like that).
My issue is that it took them about 2 months to contact me but it only takes them a few minutes to close a file. So they basically told me to fuk off!!! Great help B of A$$es. What an American dream of being a homeowner.
I am only half a month behind on my mortage with BofA and they sent a check for $459.69 stating that they wouldn't accept a partial payment. The partial payment I made was for almost $900 so they didn't even send the correct amount.
I think B of A discriminates aganist senior citizens with there harassing phone calls NINE times in twelve days. One payment behind. I think they want seniors to give up. This way they can foreclose and resale the home to younger people.
I've been trying for a modification for two years. Investor Deutche Bank.
I tried for 2 years to do a short sale of my house and BOA would not work with me. The foreclosure sale was on Sept 12 and my buyer went to bid on the property. There was no-one from BOA to conduct the auction. BOA says that they conducted a fair auction. Fair - NO ONE was there to take any bids. When trying to save my house they would only help if I paid 45,000.00. If I had that kind of money, I would not have fallen behind.
Hi, Me and my wife just got approved ,saving agrand a month from BOA, THE KEY my friends is to hire a lawyer who speicalizes in realastate and not to just let a loan mod service do it all, be involed in every matter, form or question the bank might have.The lawyer i had over saw everything and helped with questions i had. Let the bank know you have a lawyer and your no push over ,but be level headed and nice to them and answer any questions they might have orforms tey want over and over.Be careful what you say on the phone the reps will ask if your status is changing in the near future like making more money, say no cause if it does change you maybe dont need a loan mod ,Good luck to every one trying .
i have an even better story. i have never had a problem paying my mortgage. i have made every payment. i have never been late with a payment. i have a good job, i provide just fine, all my taxes/insurance paid on the property...they started sending my house payments back, refused to accept them. then they foreclosed on me. they won't provide figures to reinstate. i just flat out don't understand. it makes no sense. because they've foreclosed, i can't do anything about it, even though some depts admit they've made some kinds of mistakes, but yet it's in foreclosure so too bad. i have never seen anything like it. i don't even know what to do.
For the first time in 21 years due to my husbands lay off we got 2 1/2 months behind with boa, got automated phone calls every night around 8:15 after 1 month behind, tried to pay what we were behind on, was turned over to a debt collector & they refuse to work with us. Now we are in pre-forclosure not to mention Fannie Mae is involved now & 4 months behind because no one will tell us what we owe. We are trying to pay what we are behind on & they won't let us. I would NEVER do business with BOA again & shame on them for using the name "America"! They are a disgrace to the American people!!!

ok so i tell them i need to do something because my business is super slow, ok they send me a packet but tell me if ive just purchased a new car in the last year i wont qualify,, so i didnt fill it out, i talk to someone else they say to just stop paying because they typically wont do anything until your 3 months behind, so i call RIGHT before i get 3 months behind, and make a payment, i got scared. so they recieved the payment on the 16th of march, my loan lady tells me to just get caught up, i say ok, so im about to make another payment tomorrow , i recieve a letter in the mail stating that is i dont pay the full two months that are in the rear by april 6th , that my home will go into foreclosure,,,,,ummmm how is that ,,are you serious, i know people that have not paid their house notes for over a year , and they are still in their homes.so how is this happening, but anyways, i just left missBailey a message on her fone , because this is just rediculous! renting seems tobe better than home ownership because they play so many runaround games.BANK OF AMERICA SUCKS, SERIOUSLY!AND I MEAN IT! they r a joke, im sure ill hear from someone by tomorrow ill keep you all posted as to what becomes of this, oh! ive only been in my home for 3 years,, go figure right??..............to be continued ladies and gents,,
I think this Jonathan Gillham should be ashamed of himself posting this web page!! We all know it is a lie BOA does not and will not help anyone. I put so many complaints in that I ran out of people. I live in Mass I even talked to my Attorney General no one can help us or will. My husband was out of work when the recession hit I got behind then i got caught up they offered us a modification the person I was dealing with said I haven't heard of anyone getting denied so of course we where stupid we did it. Guess what we got denied plus it took 6 months instead of 3 and we are accountable for the late fee's and difference between our mortgage and modification amount so you know what that means we will never be even close to being caught up our credit is junk so no one will take us. So this person Jonathan you know the truth I hope you can sleep at night.
I have to tell you all I did all that. I sent the emails to CEO talked to someone in his office and still did not get help it got worse. Tose of you that said you got approved for the modification becareful. They told me the same thing then 6 months later I got denied and owe them more money and they report you late to the credit bureau. Also for the person who got a lawyer I did that too my lawyer told me to ride it out because they worded the modifcation for only loan officers to understand it.

Here's my story,I went through difficult process of divorce, applied for modification, received trial period packet/payment plan last June 2011, completed 3 months trial period on a timely manner (Aug, Sept, Oct) Called BAC before and after completeing trial payment, I was told that it was still on review....and just wait for the final papers to come in mail. Someone came inspect the property last month and leave a BAC number to call , I called immediately, and I was directed to "my account manager" He askED me to fax again updated pay stub, hardship letter, 4506t, etc., and told me tht my papers are still under review...for that long? and needeD updated information. And told me to call him or he will call me every 7 days, and I've been follwoing up every week since last month. What to expect with this situation? Need help please....Thank you
Be glad that you aren't getting anywhere with the loan modification program with B of A. My 77yr old mother was approved of one. Guess what! They bank increased her payments by over $300 per month. She said forget it, cancel my request. If she couldn't afford monthly payments of $554 how could she agree to pay over $800 per month. They are refusing to cancel her request of the loan modification and are threatening to foreclose on her if she doesn't make the 3 month trial payments. This is a very huge problem for my mom now. This bank should be closed down.
My mom is about to lose her home that she has been living in for almost 30 years. And this house means alot to us has lots of memeories in it. And we just lost my dad. She is drawing disbility and its lower then the house payment and they are saying she doesn't have enough income which duh that why we want to try and lower payment she sent in paperworks in time beacuse i took them in and faxed them. The lady said we should have called when we did and she never answered the phone and she got the paper off her fax machine late and turned them in and now they saying they can't help us because we turned in papers late which is a LIE!!! We have been on it since they been working with us. I dont know what else to do Bank of America is so screwed up. And i just know my mom is going to go down hill if shes loses this house and have another attack. I try and help her as much as i can.
We have been getting the run-around for over a year. No matter what we turn in they request something else. When we got a denial a month ago, my husband called to see why we had been denied. After leaving messages for over a week, we found out it was because they had messed up and only used my income and didn't include my husbands. So they told us to fax documents again. We did and heard nothing for a few weeks. We called and left messages and eventually got another denial in the mail. We had been calling for two weeks to see what had gone wrong. Until we got a third party involved we didn't get any answers. They had again only used my income and told my husband that for them to consider his income we would have to start over with loan modification process. Seriously, we had turned all that stuff in to begin with, on application, check stubs and tax returns, it was their mistake, yet they are going to make us start over. So why didn't they say that a month ago. They are liars and a money hungry, ruthless bank that does not care to help its customers. It's easier to throw them out on the street, kids and all! I have even sent extra with my regular payment and they return it because it's not a full payment. I requested to have bi-weekly payments deducted from my account to get caught up and they refused.
I agree, Gillham should be ashamed of printing such an article, it is nothing but lies, but I'm sure he is not about to be thrown out on the street by BAC!
The big question is, where do I find a good lawyer that can help? Surely some of the stuff BAC is doing has to be illegal.
